Marvin Schick’s Dishonesty and the Jewish Week’s Role

Marvin Schick has another disingenuous ad in the Jewish Week. In it, under the headline, "What’s Wrong With Mesirah," (informing; telling the police, media or government about crimes committed by Jews) Schick tells us: everything is wrong with mesira.

Schick’s argument is simple. American (and Israeli) justice is unfair and imperfect. Criminals are not given the option of restitution rather than jail. Therefore, you should not tell the police about crimes committed by Jews. Schick has one caveat to this blanket condemnation of reporting Jewish criminals to police.

He writes, "There are instances of spousal abuse, child abuse, and other situations where leading Orthodox rabbis have instructed that civil authorities be notified."

What Schick does not tell you in his carefully parsed language is that those instances are few and far between. Only one or two haredi rabbis of note have endorsed going to the police and that endorsement has been on a case by case basis. Indeed, a wide range of leading haredi rabbis both knew about Rabbi Kolko’s abuse and forbade victims and parents from going to the police. Rabbis as diverse as Elya Svei, Avraham Pam, and ArtScroll’s Nosson Scherman all are said to have known about the allegations. Pam and Scherman fought to have Kolko banned from teaching. None went to the police and Rabbi Kolko continued to abuse young boys. Take a moment and read the alleged history of Rabbi Kolko and the rabbinic coverup.

Schick continues, "The yeshiva deans who compromise the board of Torah Umesorah, the National Association of Hebrew Day Schools, adopted a policy statement …" What is this policy statement? It is an old statement about child abuse, in place during the last years of Rabbi Kolko’s abuse but not enforced. Schick does not bring the meat of the policy statement. All we know from what he quotes is that Torah Umesorah agrees that child abuse is bad and that, according to a letter sent by the organization’s executive director, "If there is indeed an allegation of child abuse, and that allegation proves to be true, and the matter that had come to your attention was not attended to, you will be liable both in the eyes of G-D and according to secular law."

What Schick does not tell you is that Agudath Israel of America and Torah Umesorah both opposed mandatory reporting law that would have made rabbis mandatory reporters of suspected abuse. If that law had been in place, many of the "gedolim" would now be facing criminal charges in the Kolko affair.

Schick concentrates much of this week’s ad decrying the imprisonment of financial frauds, cheats and thieves. What Schick does not tell you is that his beloved nephew is one of them, having defrauded dozens of investors out of hundreds of thousands of dollars. This would be a disclosure any journalist would need to make. Schick – who uses his bought and paid bully pulpit to club the press – does not make this necesary disclosure because he holds the press to a higher standard of honesty than he holds himself or his community.

Which brings us to the Jewish Week. Schick’s ‘columns’ are paid advertisements, and need to be labeled as such by the Jewish Week. Indeed, the Jewish Week promised me months ago that they would begin doing so immediately. If you look at the PDF of the ad (Download schick_mesira.pdf ), you’ll note that, within the borders of the ad there is one small line of type that reads, "This space is privately sponsored." No respectable publication would consider that a sufficient disclaimer. Indeed, the standard disclaimer on any ad of this type (something that does not look like display advertising) is to label it, "Paid Advertisement," and put that label above and under the ad to show the newspaper is not a party to the ad’s contents, and to do so in a way that cannot easily be missed.

The Jewish Week ran Schick’s paid ads – ads that in some cases libeled others – without a disclaimer. Now it runs them with a small,  ambiguous note within the ad itself.  Gary Rosenblatt and Company know better. Schick is a stain on the Jewish Week, and that stain is made measurably larger by this type of deceptive behavior. Put more simply, it makes you look dishonest, Gary.

    Dont be so quick to send Jews to prison. For 12 years, I was the Jewish Chaplain here in the Ma. prison system. I met Jews who feared for their lives. There are large black gangs, Hispanic gangs,etc. There is no Jewish support group because there are so few Jews in the system.
    I am not defending Kolko and his kind. But in general, be very careful before sending a Jew to jail. Remember what happened to Earl Kugel.

    What many people are missing is that the thieves and all sort of (so called )Frum criminals are banking on the above attitude. They are not afraid of Bais Din etc. since Bais Din has no real power anyway.

    How do I know this. Years ago my parents house was robbed on Shabbos by to Frum neighborhood boys. Many people witness the crime however no one wanted to help. I went to the police and before I finished telling the detective the whole story he mention the boys name and said everybody knows they steal but as long as the community protects them there is nothing the police can do and why should I. I said he is right and I will fight this. However, with no help from anybody in Boro Park there was not I could do. Amazingly the way I was treated one would think I was the thief.

    In the end the boys called (I guess they were getting some grief from my actions)and returned the money and Jewelry. When I asked them why steal from your own kind. They said it was simple, there is no risk really if they get caught since no one would go to the police, however, a Goy (gentle) would.

    A little footnote to the story. When people heard the story
    that my parent house was robbed they where shocked. However, they where not shocked at the robbery. They where shocked it happened of Shabbas. They (the community)said when I told them the story, “it could not be true,how could they carry the stolen stuff home on Shabbas”. (this was before the Eruv)

    Somehow stealing did not bother the masses but carrying on Shabbos did.

    Innocent people wind up in jail too. Even if its only temporary. Earl kugel was at the prison where he was murdered for only 2 days before it happened. Jail is a dangerous place especially for Jews. I worked there for 12 years so I know what Im talking about.Most of you people have no idea of what prisons are about. I could write a book of all the things I saw and heard.

    Earl Kugel hmmm wasn’t he JDL out in LA and they wanted to bomb some political type. Entrapment I think too.
    Well back many years ago I was interviewed by the FBI about my Jewish right wing activities (take a guess) Anyway the agent says what you do If someone in your group wanted to bomb (kill, etc) a Arab? I said, “I kick him out cause I figure he is some kind of ‘Agent Procateur'” Well that JDL type could have made that same decision. Even if it was entrapment he was still guilty!!
    Listen you bunch of bleeding hearts when you put in prison you are put in with dregs of society and JUST how are you going to fix that?

    The kind of violence you refer to is generally endemic in a facility that houses violent felons. The minimal security prisons are usually where white-collar offenders are sentenced.

    I’m baffled at how Marvin Schick takes himself seriously. Even if he paid millions for the ad it still wouldn’t be journalism. Attempting to pass off pseudo-advertorials for the real thing is just dumb on his part, and unethical and offensive on the part of the publication. What an egomaniac.

    May I be allowed a few random comments:
    I recall reading that the late rav Yankev Kamenetski upon being told of some frum Jews in jail for some serious white collar offenses remarked “zollen zay zitsen” \Let them sit –
    You are correct in showing the duplicity of Dr. Schick. Although in general he is a keen observer of american jewish life and a breath of fresh air comapred to his younger Charedi colleagues, he is blind to the fact that his nephew’s problems clearly cloud his thinking on a number of issues.
    Finally if the ban against mesirah is to remain a serious alternative, then there needs to be a SERIOUS and HONEST Besdin (Beth Din) whose transactions, decsions and proceedings should be a matter of public record as are those of the secular courts in the US.
    As we speak is there a honest Beth Din here that deals with matters beyond rent disputes and service issues (the Beth Yosef Beth Din).If there is please tell me their address.I question if the large barei din dealing with divorces are completely above board, maybe ?
    There needs to ba standing court of 4 full time dayanim and a registrar of a serious calibre acceptable to the Aguda, Satmar, Yeshiva world, Ger and other large communities.
    Each dayan should be apid $100,000 per annum and not allowed to accept any other fees not even $1-. The proceedings have to be reocrded or videotaped as suggested by rabbi Moshe Tendler.
    If such a court is created than the ban on Messirah has a chance, otherwise its hot air and a free ride for the frun fat cats and their constant search for new sources of cash.

    Ma Rabbi most of us people don’t want to know what prisons are about. Thats why we don’t break the law. One thing I do know is that every person in prison says their innocent imagine that.

    If the prision environment is so dangerous (and some are notoriously so), then we should all be pushing for improved prison conditions, changes in legislation that would decriminilize certain behavior and, perhaps, reductions in sentences for certain offenses. The solution is not, however, to protect Jewish criminals. Jews are subject to the same laws–and thus the same punishments–as everyone else in our society. And victims of Jewish criminals (who are often Jews themselves) deserve justice just as much as any other victim–something the Kolko matter demonstrates that the religious community is not able to provide.

    Think that’s Earl Krugel who planned a terrorist bombing and was later killed in prison.
    Plenty of non jewish prisoners get attacked in prison, are you recommending we send no criminals to jail? We should have better, safer prisons but the first obligation of criminal justice is to protect the victims.
    But the Jewish leadership works only to protect its criminal buddies at the expense of the people who are supposed to follow these so called Rabbis. Besides it looks like Haredim can put up a good fight – look how they beat up that black kid in Lakewood and the (frum) woman on the bus in Jerusalem. Speaking of that, I see the Haaretz article linked on The Drudge Report.
    Think any Haredi “rabbi” will speak out against the assault of this woman? – Ha! if they say anything it will be an attack on the woman for causing a chillul hashem.
    How can any jew criticize the Taliban when we have such a crowd among us.
    If all the jews who should be jailed were jailed there’d be plenty to form support groups.

    Maybe you should learn the facts from multiple eyewitnesses before you slander the Lakewood population. The Yerushalmi thugs on the bus did commit a travesty, but there was no travesty in Lakewood except on the part of the Negro liars who will do anything to protect their own.
